Please read these Terms carefully. By accessing or using the Site and/or booking or requesting Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
Important Notice: Cortex Waves Solution is not a law firm and does not provide legal advice. Telecom services in the United States may be subject to federal (including FCC) and state regulations. You should have these Terms reviewed by qualified legal counsel before relying on them for compliance.
By accessing or using the Site, submitting information through the Site, and/or booking or requesting Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies referenced herein, including our Privacy Policy (if published), which is incorporated by reference.
Cortex Waves Solution provides a platform that may allow users to request information, submit inquiries, and/or book or schedule telecom-related services (for example, internet, cable, phone, installation, and related service appointments) where available. Depending on the offering, Cortex Waves Solution may act as a marketing, lead-generation, or booking/scheduling facilitator, and not as the telecom carrier or the entity that ultimately provides the underlying telecom service.
To use the Services, you represent and warrant that: (a) you are at least 18 years of age (or the age of majority in your jurisdiction, if higher); (b) you have the legal capacity to enter into a binding agreement; (c) you will provide accurate, current, and complete information, including service address and contact details; and (d) you are requesting services only for locations within applicable service areas.
The Services may involve third-party carriers or service providers (for example, Spectrum, AT&T, Xfinity, or other providers, where applicable). Cortex Waves Solution is not responsible for the acts or omissions of third parties. The underlying telecom services are provided by third parties under their own terms, policies, service agreements, acceptable use policies, and privacy practices, which may apply in addition to these Terms. You are responsible for reviewing and agreeing to the third party’s terms before receiving services.
You agree to: (a) provide accurate and complete information (including service address, unit number, and contact details); (b) ensure safe and timely access to the premises for technicians, including any necessary permissions; (c) maintain a safe environment for service installation and performance; and (d) comply with all applicable laws and third-party provider requirements.
Service availability depends on coverage areas, technical feasibility, network capacity, credit/identity verification (if applicable), and other conditions determined by the service provider. Availability is not guaranteed until confirmed by the applicable provider and/or technician.
To the fullest extent permitted by law: (a) Cortex Waves Solution is not liable for service outages, performance issues, installation delays, missed appointments, or service quality attributable to third-party carriers or providers; (b) Cortex Waves Solution’s total liability for any claim arising out of or relating to the Site or Services will not exceed the amount you paid to Cortex Waves Solution (if any) for the specific booking giving rise to the claim; and (c) in no event will Cortex Waves Solution be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, or business interruption, even if advised of the possibility of such damages.
Your use of the Site and Services is subject to our Privacy Policy (if published). The Privacy Policy describes how we collect, use, share, and protect personal information, including contact details submitted for booking and communications purposes. Where required, you consent to such collection and use in accordance with applicable law.
By providing your phone number and submitting a request, inquiry, or booking through the Site, you expressly consent (where permitted by applicable law) to receive communications from Cortex Waves Solution and/or its partners and service providers, including via telephone calls, prerecorded/artificial voice messages, and SMS/text messages, at the number you provide, for purposes related to your request, appointment scheduling, confirmations, service updates, and customer support. Message and data rates may apply.
Consent is not a condition of purchase. You may opt out of text messages at any time by replying STOP (or as otherwise instructed in the message). For help, reply HELP or contact us using the information in Section 15. We will honor opt-out requests as required by law.
We may suspend or terminate your access to the Site or Services at any time, with or without notice, if we believe you have violated these Terms, provided false information, misused the Site, engaged in fraudulent or unlawful activity, or if termination is necessary to protect our interests, other users, or third parties.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Texas, and you consent to the jurisdiction of such courts.
We may update these Terms from time to time. Any changes will be effective when posted on the Site, unless otherwise stated. Your continued use of the Site or Services after the posting of updated Terms constitutes your acceptance of the changes.
